1) About us
These Terms govern your use of tixcounter.com.au (“Site”) and any services we provide (“Services”). In these Terms, “TixCounter”, “we”, “us”, or “our” refers to the operator of this Site.
2) Definitions
- Event means an event listed on the Site.
- Event Organizer means the person or entity responsible for an Event (including refunds and event delivery).
- Attendee means a person who purchases or uses a ticket.
- Ticket means an entry right or reservation for an Event (including QR code ticket).
- Order means a purchase of a Ticket through our checkout.
3) Platform role (very important)
TixCounter provides technology to list Events, sell Tickets, and support entry via QR check-in. Unless we clearly state otherwise for a specific Event:
- We are not the Event Organizer and do not control the Event venue, schedule, safety, content, or delivery.
- The Event Organizer is responsible for the Event, including compliance with laws, permits, insurance, staffing, venue rules, accessibility, and any advertised goods/services.
- Your Ticket purchase is primarily a contract between you and the Event Organizer.
Where we facilitate payment collection, you authorise us to act as a limited payment collection agent for the Event Organizer solely to process your Order through our payment provider(s). This does not change that the Event Organizer remains responsible for the Event and refunds.
4) Orders, tickets, and entry
- Ticket delivery: Tickets and confirmations are typically delivered electronically (email and/or account access). You must provide accurate contact details.
- QR check-in: Entry may require scanning a QR code. Protect your QR code—treat it like cash. Sharing may allow others to use it.
- Venue rules: Entry may be refused if you breach venue rules, capacity limits, security requirements, ID checks, or safety directions.
- Resale/scalping: Tickets may not be resold above face value or transferred where prohibited by the Organizer or applicable laws.
- Accuracy: Event details are provided by the Organizer. Always check the Event page for latest info.
5) Payments (Ticket Commerce + Stripe)
Payments are processed using Ticket Commerce and Stripe (and any additional Stripe-supported payment methods enabled for checkout). TixCounter does not store full credit card details—Stripe handles sensitive payment data according to its security standards.
- Fees: Ticket prices are set by the Event Organizer. Any payment processing fee shown separately at checkout helps cover fees charged by our payment processor (for example, Stripe). This fee is GST inclusive where applicable.
- Failed/flagged payments: Orders may be declined or delayed by Stripe’s risk controls or your bank’s verification processes.
- Chargebacks: If you initiate a chargeback, we may share Order details with Stripe and the Organizer to respond to the dispute.
6) Refunds and cancellations
- Organizer rules: Refund eligibility, timeframes, and conditions are set by the Organizer and/or displayed on the Event page.
- Event changes: Events may be changed, postponed, relocated, or cancelled. The Organizer is responsible for communications and refunds/credits where applicable.
- Contact: Refund requests should be directed to the Organizer (or as stated on the Event page). We may help route your request but do not guarantee outcomes.
Australian Consumer Law: Nothing in these Terms excludes non-excludable consumer guarantees or rights under the ACL. Where allowed, our liability is limited as described below.
7) User conduct
- You must not use the Site to break laws, mislead others, attempt fraud, interfere with security, or scrape/abuse our systems.
- You must not attempt to access other users’ accounts, QR codes, or attendee lists without permission.
- We may suspend access where we reasonably suspect misuse, fraud, or security risk.
8) Intellectual property
Site content, branding, design, and code are owned by or licensed to TixCounter. Event content is typically owned by the Organizer. You may not copy, reproduce, or commercially exploit content without permission.
9) Disclaimers
- We provide the Site and Services on an “as is” basis and do not guarantee uninterrupted availability.
- We do not guarantee the quality, safety, legality, or suitability of any Event, Organizer, or venue.
- We are not responsible for travel costs, accommodation, time loss, or other consequential losses relating to Event issues.
10) Limitation of liability
To the maximum extent permitted by law (and subject to non-excludable ACL rights), TixCounter’s liability to you for any claim relating to the Site or Services is limited to one of the following (at our option):
- re-supplying the Services; or
- payment of the cost of having the Services supplied again; or
- where the claim relates to an Order processed by us, the fees we received for that Order (excluding amounts passed to third parties), if any.
We are not liable for indirect, incidental, special, or consequential losses (including lost profits, lost opportunity, or loss of data), except to the extent such limitation is not permitted by law.
11) Indemnity
You agree to indemnify TixCounter against claims, losses, and expenses arising from your misuse of the Site, breach of these Terms, or violation of law, except to the extent caused by our negligence or breach of law.
12) Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
13) Governing law
These Terms are governed by the laws of Australia and the courts of the State/Territory in which we are established (unless otherwise required by law).

3) Payments and Stripe
Payments are processed by Stripe via Ticket Commerce. Stripe may collect and process payment information (including card details) under its own privacy and security practices. TixCounter generally receives only payment confirmation and limited transaction details (for example, payment status, last 4 digits, and receipt reference where available).
4) How we use your information
- To process Orders, deliver tickets, and enable QR check-in at Events.
- To provide customer support and respond to enquiries.
- To prevent fraud, abuse, and security incidents.
- To send service messages (e.g., ticket confirmations, important Event updates routed through the platform where applicable).
- To improve our Site (analytics, performance monitoring).
- To comply with legal obligations and handle disputes/chargebacks.
5) Disclosure (who we share with)
We may share your information with:
- Event Organizers (so they can manage attendance, entry, communications, and refunds where applicable).
- Stripe (payment processing, fraud prevention, chargeback handling).
- Service providers we use to operate the Site (hosting, email delivery, analytics, security).
- Authorities if required by law, court order, or to protect rights and safety.
6) International data transfers
Some service providers (including payment and hosting providers) may store or process data outside Australia. Where this occurs, we take reasonable steps to use reputable providers and apply appropriate safeguards.
7) Cookies & analytics
We may use cookies and similar technologies for site functionality, security, and analytics. You can control cookies via your browser settings. Disabling cookies may affect parts of the Site.
8) Marketing
